Notably, the Office of the Privacy Commissioner (OPC) claimed the Liberal government <a href=\"https:\/\/mobilesyrup.com\/2021\/10\/25\/privacy-commissioners-office-wasnt-consulted-on-liberal-online-harm-bill\/\" data-old-href=\"https:\/\/mobilesyrup.com\/2021\/10\/25\/privacy-commissioners-office-wasnt-consulted-on-liberal-online-harm-bill\/\" data-lasso-id=\"174954\">hadn\u2019t consulted with it<\/a> back in October, which is concerning given the online harm regulations\u2019 potential to undermine Canadian privacy rights.<\/p>\n<p>In the report, the government said that respondents were \u201clargely supportive\u201d of some proposed elements, including:<\/p>\n<ul>\n<li>A framework that would apply to all major platforms;<\/li>\n<li>The exclusion of private and encrypted communications and telecommunications services;<\/li>\n<li>Accessible and easy-to-use flagging mechanisms and clear appeal processes for users;<\/li>\n<li>The need for platform transparency and accountability requirements;<\/li>\n<li>The creation of new regulatory machinery to administer and enforce the regime;<\/li>\n<li>Ensuring that the regulatory scheme protects Canadians from real-world violence emanating from the online space; and<\/li>\n<li>The need for appropriate enforcement tools to address platform non-compliance.<\/li>\n<\/ul>\n<p>The report also outlined several areas where respondents expressed concern, including:<\/p>\n<ul>\n<li>Apart from major platforms, what other types of online services would be regulated and what the threshold for inclusion would be;<\/li>\n<li>What content moderation obligations, if any, would be placed on platforms to reduce the spread of harmful content online, including the 24-hour removal provision and the obligation for platforms to proactively monitor their services for harmful content;<\/li>\n<li>The independence and oversight of new regulatory bodies;<\/li>\n<li>What types of content would be captured by the regime and how that content would be defined in relation to existing criminal law;<\/li>\n<li>The proposed compliance and enforcement tools, including the blocking power; and<\/li>\n<li>Mandatory reporting of content to law enforcement and national security agencies or preservation obligations.<\/li>\n<\/ul>\n<h2>Next steps and other concerns<\/h2>\n<p>In the coming weeks, the Department of Canadian Heritage plans to \u201cengage a group of experts\u201d who will collaborate with stakeholders and Canadians to provide advice to the government on how to adjust the proposal. In a <a href=\"https:\/\/www.newswire.ca\/news-releases\/the-government-of-canada-releases-what-we-heard-the-government-s-proposed-approach-to-address-harmful-content-online-867463514.html\" data-old-href=\"https:\/\/www.newswire.ca\/news-releases\/the-government-of-canada-releases-what-we-heard-the-government-s-proposed-approach-to-address-harmful-content-online-867463514.html\" data-lasso-id=\"174955\">press release<\/a>, the government said that the work \u201cwill be carried out in a transparent and expedited manner.\u201d<\/p>\n<p>Pablo Rodriguez, Minister of Canadian Heritage, will propose a revised framework \u201cas soon as possible.\u201d Further, the government says it\u2019s committed to \u201cgetting this right\u201d and doing it \u201cas quickly as possible,\u201d although those two commitments seem at odds with each other.<\/p>\n<p>Some expressed concern about the <em>What We Heard <\/em>report as well. Advocacy group OpenMedia shared on Twitter that the government\u2019s acknowledgement of wrongdoing \u201cbarely scratches the surface\u201d and called for concrete changes in upcoming versions of the proposal.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Fixing the online harms proposal won\u2019t be easy.
