And owners of other products may also see fewer repair barriers, depending upon how two new pieces of federal legislation are received.<\/p>\n<p>The Agriculture Right to Repair Act [<a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.tester.senate.gov\/files\/Legislation\/Ag%20Right%20to%20Repair%20Bill%20Text.pdf\">PDF<\/a>], a US Senate bill introduced on Tuesday by Senator Jon Tester (D-MT), aims to force farm equipment makers to provide parts, documentation, software, and tools for repairs to third parties on reasonable terms.<\/p>\n<p>The Freedom to Repair Act, <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/jones.house.gov\/media\/press-releases\/reps-mondaire-jones-and-victoria-spartz-introduce-freedom-repair-act\">introduced<\/a> to the House of Representatives on Wednesday by US Representatives Mondaire Jones (D-NY) and Victoria Spartz (R-IN), promises to &#8220;legalize repairing what you own or taking it to the repair shop of your choice&#8221; by revising copyright law.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"condor\" data-xsm=\",fluid,mpu,\" data-sm=\",fluid,mpu,\" data-md=\",fluid,mpu,\">\n        <noscript><br \/>\n            <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_onprem\/personaltech&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=2&amp;c=2YfsOdUa@fdnopWLGeMGBywAAAAI&amp;t=ct%3Dns%26unitnum%3D2%26raptor%3Dcondor%26pos%3Dtop%26test%3D0\" target=\"_blank\" rel=\"noopener\"><br \/>\n                <img decoding=\"async\" src=\"https:\/\/mailinvest.blog\/wp-content\/themes\/breek\/assets\/images\/transparent.gif\" data-lazy=\"true\" data-src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_onprem\/personaltech&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=2&amp;c=2YfsOdUa@fdnopWLGeMGBywAAAAI&amp;t=ct%3Dns%26unitnum%3D2%26raptor%3Dcondor%26pos%3Dtop%26test%3D0\" alt=\"\"\/><\/a><br \/>\n        <\/noscript>\n    <\/div>\n<p>The FTR Act [<a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/jones.house.gov\/sites\/evo-subsites\/jones.house.gov\/files\/evo-media-document\/Freedom%20to%20Repair%20Act.pdf\">PDF<\/a>] exempts &#8220;the diagnosis, maintenance, or repair of digital electronic equipment&#8221; \u2013 except medical devices \u2013 from the anti-circumvention provision of the Digital Millennium Copyright Act. It also exempts the manufacture, sale, and importation of circumvention products that enable repairs of non-medical devices. It requires companies to do the following for the sake of for diagnostics, maintenance, or repair:<\/p>\n<ul>\n<li>Make documentation, parts, software, and tools available.<\/li>\n<li>Enable the removal and restoration of digital locks or security functions.<\/li>\n<li>Allow third-party software that provides interoperability with parts and tools.<\/li>\n<li>Ensure that patents and copyrights of discontinued documentation, parts, software, or tools get placed in the public domain.<\/li>\n<li>Ensure that common tools can be used for repairs without damage or offer specialized tools on reasonable terms.<\/li>\n<li>Give farmers control over their data, which equipment makers currently collect and sell.<\/li>\n<\/ul>\n<p>&#8220;I\u2019ve been a farmer my whole life, and I\u2019ve seen the unfair practices of equipment manufacturers make it harder and harder for folks to work on their tractors themselves \u2013 forcing them to go to an authorized mechanic and pay an arm and a leg for necessary repairs,&#8221; said Senator Tester in <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.tester.senate.gov\/?p=press_release&amp;id=8866\">a statement<\/a>.<\/p>\n<p>&#8220;Manufacturers have prevented producers from fixing their own machines in order to bolster corporate profits, and they\u2019ve done it at the expense of family farmers and ranchers, who work hard every day to harvest the food that feeds families across the country.&#8221;<\/p>\n<h3 class=\"crosshead\">\n  <span>Do we own this or what?<\/span><br \/>\n<\/h3>\n<p>Companies that add software to products have found they can retain control of their goods after they&#8217;re sold by limiting repair access through both digital and contractual barriers. Resentment of such practices has helped fuel the Right to Repair movement, which seeks to make ownership great again \u2013 to return control of purchased products to their owners and to restore competition to markets monopolized through intellectual property barriers.<\/p>\n<p>The problem has proven particularly acute for farmers because their machines are necessary and expensive and their margins are slim. Companies like Deere &amp; Co. have prompted <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2022\/01\/25\/john_deere_right_to_repair_lawsuits\/\" rel=\"noopener\">lawsuits from farmers<\/a> over the company&#8217;s control of spare parts, diagnostic equipment, and software tools through contracts with partners and the assertion of intellectual property rights.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"falcon\" data-xsm=\",fluid,mpu,\" data-sm=\",fluid,mpu,\" data-md=\",fluid,mpu,\">\n            <noscript><br \/>\n                <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_onprem\/personaltech&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44YfsOdUa@fdnopWLGeMGBywAAAAI&amp;t=ct%3Dns%26unitnum%3D4%26raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"><br \/>\n                    <img decoding=\"async\" src=\"https:\/\/mailinvest.blog\/wp-content\/themes\/breek\/assets\/images\/transparent.gif\" data-lazy=\"true\" data-src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_onprem\/personaltech&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44YfsOdUa@fdnopWLGeMGBywAAAAI&amp;t=ct%3Dns%26unitnum%3D426raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" alt=\"\"\/><\/a><br \/>\n            <\/noscript>\n        <\/div>\n<p>To ward off state repair bills, like Kansas&#8217;s HB 2122 in 2017, Deere &amp; Co. has argued [<a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.repair.org\/s\/Deere-Position-Paper-1-31-17-Analysis-2-7-17.doc\">.DOC<\/a>] that decisions to expand access to repair information, documentation, tools, and software should be left to the market rather than legislated.<\/p>\n<p>Gay Gordon-Byrne, executive director of The Repair Association, countered that the agricultural equipment market is essentially controlled by Deere and legislation is necessary to restore competition.<\/p>\n<p>&#8220;Ownership is destroyed by contract terms that purport to sell equipment in a complete transaction, and then add references to &#8217;embedded software licenses&#8217; that remove rights to use, repair, modify, customize, enhance, adjust, or resell purchased equipment,&#8221; she wrote in response.<\/p>\n<p>Deere did not immediately respond to a request for comment.<\/p>\n<p>Since 2014, legislation to support the right to repair products in various industries has been introduced in <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.repair.org\/legislation\">34 different states<\/a>. Now the issue is being confronted on a federal level. The Federal Trade Commission last year <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.ftc.gov\/news-events\/press-releases\/2021\/07\/ftc-ramp-law-enforcement-against-illegal-repair-restrictions\">said<\/a> it would do more to support the right to repair.
