included in a social media platform&#8217;s terms of service can do little to help it comply with transparency requirements under European law, according to recently revealed documents from a case in which Meta was fined \u20ac390 million ($414 million).<\/p>\n<p>The documents have been released by noyb, the privacy law campaign group founded by Max Schrems, the lawyer who has twice successfully challenged US-EU data sharing, including the cases (<a target=\"_blank\" href=\"https:\/\/www.theregister.com\/Tag\/Schrems%20I%20and%20Schrems%20II\/\" rel=\"noopener\">Schrems I and II<\/a>) that defeated the US Safe Harbor and Privacy Shield agreements.<\/p>\n<p>Despite nominally winning the case, noyb said it might further pursue its claim because, in its view, Ireland&#8217;s Data Protection Commission (DPC) gave Meta too long to comply with the ruling and imposed fines that were too low.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"condor\" href=\"https:\/\/www.theregister.com\/2023\/01\/04\/meta_fined_390_for_using\/\" rel=\"noopener\">reached a landmark earlier this month<\/a> when the DPC meted out a combined \u20ac390 million ($414 million) fine for violations of the EU&#8217;s General Data Protection Regulation, and directed the social media group to &#8220;bring its data processing operations into compliance within a period of 3 months.&#8221;<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"falcon\" data-xmd=\",fluid,mpu,leaderboard,\" data-lg=\",fluid,mpu,leaderboard,\" <a Board&#8217;s (EDPB) ruling in December to overturn a previous decision from the DPC that allowed Meta to add data use consent into its terms of service, seemingly in an attempt to bypass the EU&#8217;s GDPR&#8217;s requirement for explicit consent.<\/p>\n<p>The ruling assessed the question of whether, for the purposes of personalized ads, Meta provided sufficient notice to users about how their data would be used and whether it did do so transparently.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"falcon\" data-xsm=\",fluid,mpu,\" data-sm=\",fluid,mpu,\" data-md=\",fluid,mpu,\">\n            <noscript><br \/>\n                <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44Y8FRG6cykDgCNYUUGwHGSAAAAEk&amp;t=ct%3Dns%26unitnum%3D4%26raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" loading=\"lazy\" alt=\"\"\/><br \/>\n                <\/a><br \/>\n            <\/noscript>\n        <\/div>\n<p>Following the EDPB&#8217;s ruling <a target=\"_blank\" href=\"https:\/\/noyb.eu\/sites\/default\/files\/2023-01\/DPCDecision_Instagram.pdf\" rel=\"noopener\">the DPC said<\/a> [PDF] &#8220;a failure by a controller to adhere to the transparency requirements is likely to have the direct result that the data subject is misled.&#8221; (par 130)<\/p>\n<p>The DPC also tried to link Meta&#8217;s notice between specific categories of data, the purposes of the processing and the legal basis it relied on. It failed to find such a connection.<\/p>\n<p>&#8220;The Data Policy and related material sometimes\u2026 demonstrate an oversupply of very high level, generalised information at the expense of a more concise and meaningful delivery of the essential information necessary for the data subject to understand the processing being undertaken and to exercise his\/her rights in a meaningful way,\u201d it said.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" id=\"story_eagle_xsm_sm_md_xmd_lg_xlg\" data-pos=\"mid\" data-raptor=\"eagle\" data-xsm=\",mpu,dmpu,\" data-sm=\",mpu,dmpu,\" data-md=\",mpu,dmpu,\" data-xmd=\",mpu,dmpu,\" data-lg=\",mpu,dmpu,\" data-xlg=\",mpu,dmpu,\">\n            <noscript><br \/>\n                <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33Y8FRG6cykDgCNYUUGwHGSAAAAEk&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"><br \/>\n                    <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_security\/front&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33Y8FRG6cykDgCNYUUGwHGSAAAAEk&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" loading=\"lazy\" alt=\"\"\/><br \/>\n                <\/a><br \/>\n            <\/noscript>\n        <\/div>\n<p>It also said the privacy notice &#8220;generalized, repetitive information, in combination with [its] circular manner &#8230; lacks clarity and concision, which in turn means it is difficult for users to identify or have meaningful information.&#8221;<\/p>\n<p>All this made it &#8220;impossible for the user to identify with any degree of specificity what processing is carried out on what data,&#8221;
