{"id":28140,"date":"2023-01-06T10:44:56","date_gmt":"2023-01-06T10:44:56","guid":{"rendered":"https:\/\/mailinvest.blog\/index.php\/2023\/01\/06\/nhs-palantir-contract-extension-may-mean-more-legal-threats-the-register\/"},"modified":"2023-01-06T10:44:56","modified_gmt":"2023-01-06T10:44:56","slug":"nhs-palantir-contract-extension-may-mean-more-legal-threats-the-register","status":"publish","type":"post","link":"https:\/\/mailinvest.blog\/index.php\/2023\/01\/06\/nhs-palantir-contract-extension-may-mean-more-legal-threats-the-register\/","title":{"rendered":"NHS Palantir contract extension may mean more legal threats \u2022 The Register"},"content":{"rendered":"<p> <a href=\"https:\/\/go.fiverr.com\/visit\/?bta=1052423&nci=17043\" Target=\"_Top\"><img loading=\"lazy\" decoding=\"async\" border=\"0\" src=\"https:\/\/fiverr.ck-cdn.com\/tn\/serve\/?cid=40081059\" loading=\"lazy\"  width=\"601\" height=\"201\"><\/a>\n<\/p>\n<div id=\"body\">\n<p>Campaigners have warned publicly funded healthcare system NHS England that extending its contract with Palantir without meaningful consultation with patients could lead to a challenge in court.<\/p>\n<p>Following the quango&#8217;s decision to <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2023\/01\/04\/palantirs_covidera_uk_health_contract\/\" rel=\"noopener\">extend<\/a> its controversial contract with the US spy-tech firm by six months \u2013 and \u00a311.5 million ($13.68 million) in value \u2013 the data privacy and legal group Foxglove has said NHS England had not met the terms it agreed in March last year following a legal challenge.<\/p>\n<blockquote class=\"pullquote\">\n<p>We&#8217;re old enough to remember the promises in their original blog \u2013 that this unprecedented new pool of health data was an emergency response and would be unwound at the end of the pandemic<\/p>\n<\/blockquote>\n<p>In March 2021, <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2021\/03\/30\/ukgov_caves_over_nhs_palantir_lawsuit\/\" rel=\"noopener\">the UK government promised<\/a> not to expand the roles of Palantir&#8217;s NHS England database without public consultation under threat of a judicial review from news website openDemocracy, backed by Foxglove.<\/p>\n<p>Yet NHS England has awarded the data analytics firm \u2013 which started out creating bespoke solutions such as digital-profiling tools for the <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2020\/08\/26\/palantir_s_1_ipo_filing_ice\/\" rel=\"noopener\">CIA and US immigration agency ICE<\/a> \u2013 a contract extension well beyond the terms initially set out for the system.<\/p>\n<p>During the height of the pandemic in the UK, officials had promised in a blog to &#8220;cease processing and to either destroy or return data to NHS England&#8221; after the pandemic. The notice has yet to appear.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" id=\"story_eagle_xsm_sm_md_xmd_lg_xlg\" data-pos=\"mid\" data-raptor=\"eagle\" data-xsm=\",mpu,dmpu,\" data-sm=\",mpu,dmpu,\" data-md=\",mpu,dmpu,\" data-xmd=\",mpu,dmpu,\" data-lg=\",mpu,dmpu,\" data-xlg=\",mpu,dmpu,\">\n            <noscript><br \/>\n                <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_offprem\/paasiaas&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33Y7f7qLwy84iiv-NYjrXyIQAAABU&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"><br \/>\n                    <img decoding=\"async\" src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_offprem\/paasiaas&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33Y7f7qLwy84iiv-NYjrXyIQAAABU&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" loading=\"lazy\" alt=\"\"\/><br \/>\n                <\/a><br \/>\n            <\/noscript>\n        <\/div>\n<p>Officials told <em>The Register<\/em> to expect the procurement to be launched &#8220;in the coming weeks.&#8221; The same message was given to the Financial Times in November last year.<\/p>\n<p>The government has also refused to run a public consultation on FDP as an expanded use of centralized data analytics on personal health information. In July last year, <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2022\/07\/20\/nhs_data_platform_consultation\/\" rel=\"noopener\">Minister of State for Care and Mental Health Gillian Keegan told Parliament<\/a> that NHS England was not proposing to conduct an open debate on the nature or remit of the FDP.<\/p>\n<p>Despite the delays, the controversial data platform remains part of NHS England&#8217;s plans.
