the translated police statement explains.<\/p>\n<p>Tesla&#8217;s <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.tesla.com\/en_eu\/support\/autopilot\">Autopilot<\/a> driver assistance system is available in three service tiers: Autopilot, Enhanced Autopilot, and Full Self-Driving, a term deemed misleading and disallowed in California as of January 1, 2023, under <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202120220SB1398\">SB 1398<\/a>, signed into law last September.<\/p>\n<p>How this will be enforced given Tesla CEO Elon Musk&#8217;s past resistance to government demands and court orders is anyone&#8217;s guess. But Tesla acknowledges at least that &#8220;Full Self-Driving&#8221; is only partially self-driving on its website: &#8220;Autopilot is a hands-on driver assistance system that is intended to be used only with a fully attentive driver. The penalty for failing to do so is to be locked out of Autopilot temporarily.<\/p>\n<p>Tesla drivers have attempted to flout the car manufacturer&#8217;s rules by using steering weights, referred to by the automaker as a &#8220;hands-on defeat device,&#8221; to dupe the sensors used to detect whether the driver is holding the wheel. Consumer Reports published <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.consumerreports.org\/autonomous-driving\/cr-engineers-show-tesla-will-drive-with-no-one-in-drivers-seat\/\">an article and video<\/a> showing how easy it is to fool Tesla&#8217;s hands-on sensors back in May, 2021.<\/p>\n<p>Tesla has tried to prevent abuse, most recently with the November 2022 release of Tesla Full Self-Driving (FSD) Beta v10.69.3.1, which has the ability <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/twitter.com\/teslascope\/status\/1595953734768791553\">to detect<\/a> some Autopilot defeat devices. When the system spots a cheat device, it applies a strike to the Tesla customer&#8217;s account. With enough strikes \u2013 <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.notateslaapp.com\/news\/938\/tesla-resets-strikes-with-fsd-beta-10-69-1\">three or five<\/a> depending upon whether the car has an in-cabin camera \u2013 the driver loses access to the Full-Self Driving beta test.<\/p>\n<p>The US Department of Justice <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2022\/10\/27\/doj_self_driving_car_criminal\/\" rel=\"noopener\">reportedly opened<\/a> a criminal investigation into Tesla and its self-driving technology back in October.
