As such, MSG makes total bans on all attorneys at a firm.<\/p>\n<p>The company also noted that MSG&#8217;s use of facial recognition is clearly advertised to guests, adding &#8220;we will continue to use it to protect against the entry of individuals who we have prohibited from entering our venues.&#8221;\u00a0<\/p>\n<h3 class=\"crosshead\">Welcome to the garden of surveillance<\/h3>\n<p>Facial recognition has been in use at Madison Square Garden &#8211; the venue itself &#8211; since at least <a href=\"https:\/\/www.nytimes.com\/2018\/03\/13\/sports\/facial-recognition-madison-square-garden.html?smid=tw-nytsports&amp;smtyp=cur\" rel=\"nofollow\">2018<\/a>, when <em>The New York Times<\/em> reported the arena was scanning the faces of customers. Representatives of Madison Square Garden claimed at the time it improved security and helped &#8220;provide a safe and wonderful experience&#8221; for guests.<\/p>\n<p>Privacy advocates disagree on the effectiveness of facial recognition, and have prevailed in some cases attempting to restrict the use of such technology. Clearview AI, a startup that <a href=\"https:\/\/www.theregister.com\/2021\/10\/09\/in_brief_ai\/\">scraped<\/a> images from social media pages to build a facial ID database, settled a lawsuit with the ACLU earlier this year that included a\u00a0 promise to <a href=\"https:\/\/www.theregister.com\/2022\/05\/10\/clearview_ai_alcu\/\">restrict sale<\/a> of its database to US businesses.\u00a0<\/p>\n<p>Clearview was also forced to cough up <a href=\"https:\/\/www.theregister.com\/2022\/05\/23\/clearview_ai_ico_fine\/\">millions in fines<\/a> to the UK&#8217;s privacy watchdog for scraping the web for face data.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" id=\"story_eagle_xsm_sm_md_xmd_lg_xlg\" data-pos=\"mid\" data-raptor=\"eagle\" data-xsm=\",mpu,dmpu,\" data-sm=\",mpu,dmpu,\" data-md=\",mpu,dmpu,\" data-xmd=\",mpu,dmpu,\" data-lg=\",mpu,dmpu,\" data-xlg=\",mpu,dmpu,\">\n            <noscript><br \/>\n                <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_software\/aiml&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33Y6OgSM6WvxYdpUzeFX-Q5wAAABM&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"><br \/>\n                    <img decoding=\"async\" src=\"https:\/\/mailinvest.blog\/wp-content\/themes\/breek\/assets\/images\/transparent.gif\" data-lazy=\"true\" data-src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_software\/aiml&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33Y6OgSM6WvxYdpUzeFX-Q5wAAABM&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" alt=\"\"\/><br \/>\n                <\/a><br \/>\n            <\/noscript>\n        <\/div>\n<p>MSG didn&#8217;t tell us which facial recognition software it uses, but said that only individuals it prohibits from entering its venues are in the database.<\/p>\n<p>The <a href=\"https:\/\/www.theregister.com\/2019\/06\/05\/fbi_facial_recognition_gao\/\">failure rate<\/a> of facial recognition &#8211; especially when it comes to identifying women and minorities &#8211; has been <a href=\"https:\/\/www.theregister.com\/2022\/05\/23\/clearview_ai_ico_fine\/\">well demonstrated<\/a>, and Congress even decided it was a big enough deal to <a href=\"https:\/\/www.theregister.com\/2019\/05\/22\/congress_facial_recognition\/\">hold hearings<\/a> on in 2019.\u00a0<\/p>\n<p>Regardless of the law, Conlon&#8217;s fellows at the firm aren&#8217;t letting it slide, and partner Sam Davis believes they might have the right angle to get MSG to stop barring entry: Threaten the group&#8217;s liquor license.<\/p>\n<p>According to Davis, MSG&#8217;s license requires it to admit all members of the public who aren&#8217;t deemed to be disruptive or a security threat. &#8220;Separating a mother from her daughter and Girl Scouts she was watching over \u2014 and to do it under the pretext of protecting any disclosure of litigation information \u2014 is absolutely absurd,&#8221;
