The suit does the same for triple-A games, game subscription services, console hardware and &#8220;high-performance&#8221; console systems.<\/p>\n<p>All of those markets, the plaintiffs claim, could end up suffering as a result of the Microsoft and Activision merger, and in turn that suffering could be passed onto them, and someone really needs to think of the gamers.\u00a0<\/p>\n<p>The suit claims &#8220;higher prices, less innovation, less creativity, less consumer choice, decreased output, and other potential anticompetitive effects, [would] deprive the Plaintiffs, and the public at large, of the salutary benefits of competition.&#8221;<\/p>\n<h3 class=\"crosshead\">It&#8217;ll hurt the industry, too, of course<\/h3>\n<p>The suit also claims that employees in the video game industry would be harmed by the merger because Microsoft would also have &#8220;outsized market power in hiring and retaining employees in the video gaming field, which requires specialized talent.&#8221;<\/p>\n<p>Given the recent lawsuits that Microsoft has faced over <a href=\"https:\/\/www.theregister.com\/2022\/11\/16\/microsoft_sexual_harassment_and\/\">sexual harassment allegations<\/a>, and Activision Blizzard&#8217;s problems with <a href=\"https:\/\/www.theregister.com\/2022\/01\/11\/activision_dfeh_appeal\/\">the same<\/a>, the suit said the court should be concerned about giving such hiring power to companies with their histories.\u00a0Not to mention tech companies <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2014\/04\/25\/apple_google_intel_and_adobe_settle_employeefiddling_class_action\/\" rel=\"noopener\">colluding<\/a> to drive down wages and hiring key staff.<\/p>\n<p>This, of course, is all predicated on whether the FTC&#8217;s recently-filed lawsuit to stop the merger is successful, or whether the <a href=\"https:\/\/www.theregister.com\/2022\/11\/09\/microsofts_activision_eu\/\">European Union&#8217;s investigation<\/a> into the merger shows merit to put a permanent stop to it.\u00a0\u00a0<\/p>\n<div aria-hidden=\"true\" class=\"adun\" id=\"story_eagle_xsm_sm_md_xmd_lg_xlg\" data-pos=\"mid\" data-raptor=\"eagle\" data-xsm=\",mpu,dmpu,\" data-sm=\",mpu,dmpu,\" data-md=\",mpu,dmpu,\" data-xmd=\",mpu,dmpu,\" data-lg=\",mpu,dmpu,\" data-xlg=\",mpu,dmpu,\">\n            <noscript><br \/>\n                <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_onprem\/personaltech&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33Y6OHw1eFiq6RTwSi2P8LKgAAAFI&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"><br \/>\n                    <img decoding=\"async\" src=\"https:\/\/mailinvest.blog\/wp-content\/themes\/breek\/assets\/images\/transparent.gif\" data-lazy=\"true\" data-src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_onprem\/personaltech&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=3&amp;c=33Y6OHw1eFiq6RTwSi2P8LKgAAAFI&amp;t=ct%3Dns%26unitnum%3D3%26raptor%3Deagle%26pos%3Dmid%26test%3D0\" alt=\"\"\/><br \/>\n                <\/a><br \/>\n            <\/noscript>\n        <\/div>\n<p>The actions by the FTC and EU were both justified along antitrust grounds similar to those deployed by the group of disgruntled gamers.
