Research on CRISPR sequences dates back <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.broadinstitute.org\/what-broad\/areas-focus\/project-spotlight\/crispr-timeline\">to 1993<\/a>.<\/p>\n<p>The foundational work on CRISPR-Cas9 gene editing in 2011 by Emmanuelle Charpentier, founder of the Max Planck Unit for the Science of Pathogens in Germany, and Jennifer Doudna, professor of Biomedical and Health at the University of California, Berkeley, proved significant enough to earn the 2020 Nobel Prize for Chemistry.<\/p>\n<p>Doudna, Charpentier, Martin Jinek of UC Berkeley, and Krzystof Chylinski of the University of Vienna filed the first CRISPR-Cas9 patent application in May, 2012.<\/p>\n<p>In December that year, researchers from The Broad Institute \u2013 a collaboration between Harvard University and MIT \u2013 filed their own patent application, and other patents have followed from multiple groups in the US, Europe, China, and other countries. According to Nature, the US Patent and Trademark Office (USPTO) last September <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.nature.com\/articles\/d41586-021-02420-x\">had about<\/a> 6,000 CRISPR patents or patent applications, with 200 added each month.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"condor\" data-xsm=\",fluid,mpu,\" data-sm=\",fluid,mpu,\" data-md=\",fluid,mpu,\">\n        <noscript><br \/>\n            <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_offbeat\/science&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=2&amp;c=2Yh7UWftCGz@8aZdtdeScawAAAFc&amp;t=ct%3Dns%26unitnum%3D2%26raptor%3Dcondor%26pos%3Dtop%26test%3D0\" target=\"_blank\" rel=\"noopener\"><br \/>\n                <img decoding=\"async\" src=\"https:\/\/mailinvest.blog\/wp-content\/themes\/breek\/assets\/images\/transparent.gif\" data-lazy=\"true\" data-src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_offbeat\/science&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=2&amp;c=2Yh7UWftCGz@8aZdtdeScawAAAFc&amp;t=ct%3Dns%26unitnum%3D2%26raptor%3Dcondor%26pos%3Dtop%26test%3D0\" alt=\"\"\/><\/a><br \/>\n        <\/noscript>\n    <\/div>\n<p>The Broad Institute was the first to be awarded a CRISPR patent, in April, 2014 (\u200b\u200bUS Patent No. <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.broadinstitute.org\/files\/shared\/osap\/pdf\/US8697359.pdf\">8,697,359<\/a>), based on work dating back to February 2011. CVC argued that details its researchers disclosed should invalidate subsequent Broad patent applications.<\/p>\n<p>The USPTO began its interference proceeding in 2016, and in 2017 found that the Broad Institute&#8217;s claims did not interfere with those made by CVC researchers. Following an appeal, the US Court of Appeals in 2018 affirmed that Broad Institute&#8217;s patents were separately patentable and didn&#8217;t overlap with what CVC claimed.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"falcon\" data-xsm=\",fluid,mpu,\" data-sm=\",fluid,mpu,\" data-md=\",fluid,mpu,\">\n            <noscript><br \/>\n                <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_offbeat\/science&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44Yh7UWftCGz@8aZdtdeScawAAAFc&amp;t=ct%3Dns%26unitnum%3D4%26raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"><br \/>\n                    <img decoding=\"async\" src=\"https:\/\/mailinvest.blog\/wp-content\/themes\/breek\/assets\/images\/transparent.gif\" data-lazy=\"true\" data-src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_offbeat\/science&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44Yh7UWftCGz@8aZdtdeScawAAAFc&amp;t=ct%3Dns%26unitnum%3D426raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" alt=\"\"\/><\/a><br \/>\n            <\/noscript>\n        <\/div>\n<p>Then the USPTO initiated a second interference proceeding in 2019 covering 10 CVC CRISPR patents and 13 Broad Institute patents and one Broad patent application.<\/p>\n<p>This second CVC-backed proceeding concluded on Monday with the USPTO&#8217;s Patent, Trial and Appeal Board (PTAB) issuing a decision [<a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.scribd.com\/document\/561762623\/106-115-Decision-on-Priority\">PDF<\/a>] that sides with the Broad Institute and against CVC.<\/p>\n<p>&#8220;This decision once again confirmed Broad\u2019s patents were properly issued,&#8221; the Broad Institute said in <a target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/www.broadinstitute.org\/crispr\/journalists-statement-and-background-crispr-patent-process\">a statement<\/a>. &#8220;As the PTAB and US federal courts have repeatedly established, the claims of Broad\u2019s patents to methods for use in eukaryotic cells, such as for genome editing, are patentably distinct and not reasonably expected from results of biochemical &#8216;test tube&#8217; experiments.&#8221;<\/p>\n<p>The University of California, Berkeley, expressed unhappiness with the ruling, which doesn&#8217;t affect more than 40 other CRISPR-related patents in the US, as well as patents in other countries.<\/p>\n<p>&#8220;The University of California is disappointed by the PTAB\u2019s decision and believes the PTAB made a number of errors,&#8221;
