Nathan, said in the court order that Musk&#8217;s &#8220;precise application to the Court is unclear,&#8221; <a target=\"_blank\" href=\"https:\/\/www.cnbc.com\/2022\/02\/24\/judge-rejects-elon-musks-attempt-to-bring-sec-before-the-court.html\" rel=\"nofollow noopener\">CNBC first reported.<\/a><\/p>\n<p>Last week, <a target=\"_blank\" href=\"https:\/\/www.businessinsider.com\/elon-musk-accuses-sec-of-endless-unfounded-investigations-into-tesla-2022-2\" rel=\"nofollow noopener\">Musk filed a letter<\/a> in federal court via his attorney Alex Spiro that accused the agency of harassment in the form of &#8220;endless, unfounded investigations&#8221; into Tesla. The letter said the regulator had leaked information regarding investigations into the electric carmaker and withheld $40 million in funds from a <a target=\"_blank\" href=\"https:\/\/www.sec.gov\/news\/press-release\/2018-226\" rel=\"nofollow noopener\">2018 settlement<\/a> with Tesla and Musk regarding <a target=\"_blank\" href=\"https:\/\/www.businessinsider.com\/teslas-elon-musk-settles-with-sec-must-step-down-as-chairman-2018-9\" rel=\"nofollow noopener\">his tweets around potential plans to take the company private.<\/a><\/p>\n<p>In the letter, Musk requested a conference with the SEC that would be facilitated by the US District Court to address its accusations. In response, the <a target=\"_blank\" href=\"https:\/\/www.businessinsider.com\/sec-pushes-back-elon-musk-accusations-harassment-2022-2\" rel=\"nofollow noopener\">SEC said<\/a> it has &#8220;sought to meet and confer with Tesla and Mr. Musk to address any concerns&#8221; and that it expects to submit a &#8220;proposed plan of distribution&#8221; for the $40 million in funds by the end of March. <\/p>\n<p data-p-pos=\"8_5\">Nathan said that the court cannot impose a deadline on the $40 million in funds that &#8220;does not currently exist.&#8221; The district judge also said that the CEO&#8217;s letter does not include &#8220;specific facts or legal authority&#8221; to justify &#8220;on-the-record assurance that the Commission has not leaked investigative details.&#8221;<\/p>\n<p>She noted Musk and Tesla could file a motion to inhibit an SEC subpoena, but would need &#8220;a non-frivolous basis.&#8221;<\/p>\n<p data-pos=\"16\">Musk and the SEC have had a <a target=\"_blank\" href=\"https:\/\/www.businessinsider.com\/elon-musk-and-sec-battle-timeline-2019-3\" rel=\"nofollow noopener\">rocky relationship<\/a>. As recently as last year, the SEC cited Musk for what it said were <a target=\"_blank\" href=\"https:\/\/www.businessinsider.com\/tesla-elon-musk-tweets-sec-says-violated-court-order-markets-2021-6\" rel=\"nofollow noopener\">violations of the terms<\/a> of the 2018 settlement.<\/p>\n<p>Earlier this week, Musk said on Twitter that he has been &#8220;building a case&#8221; against the SEC.
