Just 53 Australian Facebook users installed the app, but it accessed personal information describing over 310,000 Aussie users. In <a target=\"_blank\" href=\"https:\/\/www.theregister.com\/2020\/03\/09\/australian_privacy_watchdog_sues_facebook\/\" rel=\"noopener\">March 2020<\/a> the OAIC decided that warranted action against Facebook on privacy grounds because the 310,000-plus locals did not consent to info-sharing.<\/p>\n<p>One of Facebook&#8217;s defences in the case was that at the time of the data siphon it didn&#8217;t do business in Australia, so was not bound by Australian privacy law.<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"condor\" data-xsm=\",fluid,mpu,\" data-sm=\",fluid,mpu,\" data-md=\",fluid,mpu,\">\n        <noscript><br \/>\n            <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_offbeat\/legal&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=2&amp;c=2YgDbI7@kf2cfNZHs6MZ0UgAAAFU&amp;t=ct%3Dns%26unitnum%3D2%26raptor%3Dcondor%26pos%3Dtop%26test%3D0\" target=\"_blank\" rel=\"noopener\"><br \/>\n                <img decoding=\"async\" src=\"https:\/\/mailinvest.blog\/wp-content\/themes\/breek\/assets\/images\/transparent.gif\" data-lazy=\"true\" data-src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_offbeat\/legal&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=2&amp;c=2YgDbI7@kf2cfNZHs6MZ0UgAAAFU&amp;t=ct%3Dns%26unitnum%3D2%26raptor%3Dcondor%26pos%3Dtop%26test%3D0\" alt=\"\"\/><\/a><br \/>\n        <\/noscript>\n    <\/div>\n<p>That argument relied on the fact that Australians&#8217; In the <a target=\"_blank\" href=\"https:\/\/www.judgments.fedcourt.gov.au\/judgments\/Judgments\/fca\/full\/2022\/2022fcafc0009\" rel=\"noopener\">judgement<\/a>, that logic was described as &#8220;divorced from reality&#8221; because it &#8220;has the result that no internet business based in one jurisdiction can ever carry on business in another.&#8221;<\/p>\n<p>The three justices who heard the case also noticed that Facebook&#8217;s T&amp;Cs include phrases such as &#8220;Cookies and things like local storage help make Facebook work, like allowing pages to load faster because certain content is stored on your browser or helping us authenticate you to deliver personalized content.&#8221;<\/p>\n<div aria-hidden=\"true\" class=\"adun\" data-pos=\"top\" data-raptor=\"falcon\" data-xsm=\",fluid,mpu,\" data-sm=\",fluid,mpu,\" data-md=\",fluid,mpu,\">\n            <noscript><br \/>\n                <a href=\"https:\/\/pubads.g.doubleclick.net\/gampad\/jump?co=1&amp;iu=\/6978\/reg_offbeat\/legal&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44YgDbI7@kf2cfNZHs6MZ0UgAAAFU&amp;t=ct%3Dns%26unitnum%3D4%26raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" target=\"_blank\" rel=\"noopener\"><br \/>\n                    <img decoding=\"async\" src=\"https:\/\/mailinvest.blog\/wp-content\/themes\/breek\/assets\/images\/transparent.gif\" data-lazy=\"true\" data-src=\"https:\/\/pubads.g.doubleclick.net\/gampad\/ad?co=1&amp;iu=\/6978\/reg_offbeat\/legal&amp;sz=300x50%7C300x100%7C300x250%7C300x251%7C300x252%7C300x600%7C300x601&amp;tile=4&amp;c=44YgDbI7@kf2cfNZHs6MZ0UgAAAFU&amp;t=ct%3Dns%26unitnum%3D426raptor%3Dfalcon%26pos%3Dmid%26test%3D0\" alt=\"\"\/><\/a><br \/>\n            <\/noscript>\n        <\/div>\n<p>That language saw the judges conclude that given the purpose of cookies is to gather personal information \u2013 and doing so allowed Facebook to serve custom ads in Australia \u2013 the company was doing business in the land down under and therefore bound by Australian privacy laws.<\/p>\n<p>Facebook did have a minor win, on the issue of caching. A lower court had decided it was possible to infer that caching servers were operated by Facebook.
